UNITED SERVICES CREDIT UNION VISA GOLD CARD AGREEMENT

Dear customer:

This is the agreement that will cover your Visa Gold Credit Card account. Each person that signed the application will be bound by this agreement and responsible for paying all amounts owed. You agree with the terms and conditions of this agreement when you accept, sign or use your card. The words "we", "us" and "our" mean United Services Credit Union or any subsequent holder of this account. The words "you" or "your" mean each and all of those who have authorized use of the credit card. Your VISA Card may not be used for any illegal transactions.
MERCHANT ADVANCES. You can use your card to purchase goods and services at participating merchants. We will add the amount of each purchase to the part of your account we will call purchases.
CASH ADVANCES. Subject to your available credit line, you can also obtain cash advances (loans) by presenting your credit card at any financial institution displaying the VISA sign, or by using a designated Automated Teller Machine (ATM), provided a Personal Identification Number (PIN) has been issued to you. In addition, if we issue "credit card checks" you may obtain a cash advance, subject to your available credit limit, for tjhe exact amount of the check when you use it like a regular check. We add the amount of each cash advance to the part of your account we call Cash Advance.
YOUR PAYMENT PROMISE. You agree to pay us back all purchase and cash advances we make for your account, together with all FINANCE CHARGES and any fees and other charges according to the terms of this agreement.
CREDIT LINE.
We will assign you a credit line when we approve your account. You promise not to allow your unpaid balance to exceed your credit line. If we do allow you to obtain a merchant or cash advance which makes your balance exceed your credit line, you agree to pay us the excess immediately, together with any over limit fee authorized in this agreement.
We may change your credit line from time to time. We will notify you in writing if we raise or lower your credit line for any reason.
MONTHLY STATEMENTS. We will send you a statement at the end of each monthly statement period in which there is a transaction or an outstanding balance on your account. The statement will show all transactions, the unpaid balance on your account (called the "New Balance"), the amount of credit available to you (your credit line minus the new balance), the minimum payment due and the due date (25 days after the statement date)
MAKING PAYMENTS. The minimum payment due on each statement will be 3% of the new balance shown on the statement or $20.00 whichever is greater, except that if the balance is less than $20.00, it will be the entire new balance amount. Any amount overdue from a previous statement is also included in the minimum payment. You must pay any overdue payments immediately and without demand. The current part of the minimum payment is to be paid by the due date indicated on the statement.

You can always pay more than the minimum payment but, if you do, you must still make the minimum payment in each of the following statement periods until you have fully paid what you owe.

If you signed an automated payment agreement, we will automatoically pay your designated payment amount from your checking or savings account. Payments which, you yourself make, will be in addition to the automatic payment we will make for you.
LATE PAYMENTS. If you fail to pay the minimum payment on or before the fifteenth day following the due date, you may be charged a late charge equivalent to 3% of the past due payment amount.
IRREGULAR PAYMENTS. We may accept late payments, partial payments or checks or money orders labeled "payments in full" without losing our rights under this agreement.
APPLYING PAYMENTS. We will apply all payments first against any unpaid FINANCE CHARGE; next to billed cash advances; next to billed purchases; next to unbilled cash advances then to unbilled purchases.
FINANCE CHARGE. A FINANCE CHARGE accrues on every purchase and cash advance from the day each cash advance or purchase is posted to your account to the day payment of the advance is credited.

However, you can avoid paying a FINANCE CHARGE on current billing cycle purchases (those itemized on a statement) if you paid in full the new balance on your previous statement so that we receive and credit it on or before the due date indicated on that statement.
HOW WE DETERMINE THE AMOUNT OF FINANCE CHARGE. We figure the FINANCE CHARGE on your account by applying the periodic rate of FINANCE CHARGE to the "Average Daily Balance" of your account. To get the "Average Daily Balance", we start with the beginning balance of your account excluding unpaid FINANCE CHARGES. We add any cash advances posted to your account that day. We also add any new purchases unless you paid in full the New Balance on your statement for the previous billing period by its payment Due Date. We substract any credits and or payments (after any unpaid FINANCE CHARGES are paid) posted to your account that day. This gives us the daily balance. Then, we add up allthe daily balances for the billing period and divide by the total number of days in the billing period. This gives us the "Average Daily Balance". We figurte the FINANCE CHARGE on your account by multiplying the "Average Daily Balance" by a monthly periodic rate of FINANCE CHARGE. The monthly periodic rate of FINANCE CHARGE is figured out by dividing the ANNUAL PERCENTAGE RATE by 12.
ANNUAL PERCENTAGE RATE VISA GOLD.
The ANNUAL PERCENTAGE RATE in effect for the VISA GOLD credit card program is 8.9% for purchases and cash advances.
CREDITING PAYMENTS. It is to your advantage to make all payments properly and on time. All payments received on a business day will be credited on that day, provided they are received at the address and in the manner and by the time indicated by your monthly statement. Other payments may not be credited for up to 5 business days. Payments must be in United States currency.
ENTIRE BALANCE DUE. Your entire balance will be due without notice or demand if: you miss a payment, you break any of your promises under this agreement or any other agreement you have made with us: anything you told us in applying for this account is untrue; you exceed your credit line; you become insolvent or involved in bankruptcy proceedings, make an assignment for the benefit of creditors, or die.
LIMITS ON ADVANCES. We are not required to make a purchase or cash advance if: it would boost your outstanding balance over your credit line; payment of your entire balance has been accelerated for the reasons stated in the preceding paragraph; your credit card has expired; we have revoked your right to use your credit card; or your account has been closed. Any purchase or cash advances we make, even if we are not required to, will be governed by the terms and conditions of this agreement.
CASH ADVANCE FEE. A cash advance fee of $5.00 will be posted to your account for each cash advance.
OVERLIMIT FEE. If your NEW BALANCE minus any fees imposed during the cycle, exceeds your credit limit as of a billing cycle closing date you will be charged and Overlimit fee of $10.00.
COLLECTION COSTS. You agree to pay all collection costs, including reasonable attorney's fees, if we start collection proceedings.
JOINT ACCOUNT. If this is a joint account, each person who signed the application (1) may obtain purchases and cash advances (but the totals of these advances cannot exceed the credit line); (2) will be responsible for paying all amounts owed; and (3) can close the account.
TRANSFER OR ASSIGNMENT. Your rights under this agreement belong to you and to you only and may not be transferred or assigned. Your obligations, however, are binding upon your heirs and legal representatives.
AUTHORIZATIONS. Purchases and cash advances may require the Credit Union's authorization. We may limit the number or the  maximum dollar amount of the authorizations in a given day. You agree that neither we nor our agents shall be liable for refusing an authorization request.
REFUSING A CREDIT CARD. We will not be legally responsible in any way if anyone refuses to accept your credit card.
NOTICES. Any notice we send to you will be considered effective when it is delivered to you personally or mailed, postage prepaid, to the last address we have for you in our records. Notice from you will be considered effective when we receive it at the address shown in this agreement.
If this is a joint account, we can notify one of you and the notice will be effective for both of you. Similarly, one of you can notify us and we'll consider it to be notice from both of you.
CHANGING THIS AGREEMENT. We can change this agreement at any time including, without limitation, changing the periodic rates and the way we compute the FINANCE CHARGE or minimum payments. We will notify you in writing at least 30 days prior to the date on which the change is to become effective. All changes will apply to amounts at the time the change goes into effect as well as new transactions and balances unless we agree otherwise.
CLOSING YOUR ACCOUNT. You can close your account at any time. Simply notify us in writing, stop using your account and destroy your credit cards.
We can also close your account at any time. We'll notify you in writing before the closing is to become effective unless we have accelerated payments of the entire balance of your account. If we close your account, you agree to destroy your credit cards.
No matter who closes the account, we will keep all rights we have and you will still have to repay all purchases and cash advances made for your account, even if made after the account has been closed, together with FINANCE CHARGE.
Your credit card remains your property. You agree to return your card to us immediately if we ask.
REINSTATEMENT. Your account may be considered for reinstatemen, if so, you may required to provide the Credit Union with a new application.
CONVERTING FOREIGN CURRENCY. All foreign purchases and cash advances will be converted to United States Dollars, before being charged to your account.
VISA Currency Exchange Rate Policy Disclosure: Effective April 2, 2005, the exchange rate between the transaction currency and the billing currency used for processing international transactions is a rate selected by Visa from the range of rates available in whole sale currency markets for the applicable central processing date, which may vary from the rate that Visa itself receives, or the government rate in effect for the applicable central processing date. We do not control the rate, date or place of exchange. An International Service Assesment fee of 1% of the transaction amount will be posted to your account for all foreign transactions.|
LOST OR STOLEN CARDS. You agree to notify us at once if your credit card is lost or stolen or if you suspect it is being used without your permission. If your card or account is being used by an unauthorized person, you may be legally responsible, but not for more than $50.00. You will not, however, be legally responsible for unauthorized use which occurs after you notify us orally or in writing at the address shown in this agreement of the loss, theft or possible unauthorized use. OTHER FEES. Your account may be debited $30.00 as a purchase for any payment made by check which is returned to us for any reason. You may also be further debited $30.00 as a purchase for any "credit card check" which is returned by us because your account was overlimit, delinquent or closed.
EVIDENCE. If we go to court for any reason, we can use a copy, microfilm, or microfiche of any monthly statement or other document to prove that you owe us or that a transaction has taken place. The copy, microfilm, or microfiche will have the same validity as the original.
WAIVER. We may waive or delay enforcing any of our rights under this agreement without losing such rights. We may waive or delay enforcing any of our rights as to one person obligated under this agreement without affecting the obligations of any other person.
CREDIT BUREAUS. We may report information about your account to Credit Bureaus. Late payments, missed payments or other defaults on your account may be reflected in your credit reports.
WHAT LAW APPLIES? This agreement will be governed by the law of the state of North Carolina. If there is a conflict between any of the terms and conditions of this agreement and applicable law, this agreement will be considered changed to the extent necassaru to comply with the law. The other provisions shall not be affected.

YOUR BILLING RIGHTS

This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act.
Notify us in case or questions about your bill.
If you think your bill is wrong, or if you need more information about a transaction on your bill, write us on a separate sheet of paper at:

Write to us as soon as possible. We must hear from you no later than 60 days after we sent you your first bill on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights.
In your letter give us the following information:
- Your name and account number,
- The dollar amount of the suspected error,
- Describe the error and explain, if you can, why you believe there is an error.

If you need more information, describe the item you are not sure about.
If you have authorize us to pay your credit card bill automatically from your savings or checking account, you can stop the payment on any amount you think is wrong. To stop the payment your letter must reach us three business days before the automatic payment is scheduled to occur.

Your rights and our responsibilities after we receive your written notice

We must acknowledge your letter within 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the bill was correct.

After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including FINANCE CHARGES, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your bill that are not in question.

If we find that we made a mistake on your bill, you will not have to pay any FINANCE CHARGES related to any questioned amount. If we didn't make a mistake, you may have to pay FINANCE CHARGES, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date it is due.

If you fail to pay the amount that we think that you owe we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within 10 days telling that you still refuse to pay because you claim there is an error, we must tell anyone we report to that you have a question about your bill. We must tell you the name of anyone to whom we provided information about your account. We must tell anyone we report you to that the matter has been settled between us when it finally is.
If we do not follow the rules, we cannot collect the first $50.00 of the questioned amount, even if your bill was correct.

Special rule for credit card purchases.

If you have a problem with the quality of property or services that you have purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount on the property or services. There are two limitations on this right:
a) You must have made this purchase in your home state or, if not within your home state, within 100 miles of your current mailing address; and,
b) The purchase price must have been more than $50.00

These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services.
